Move Me – Terms and Conditions & Disclaimer

By using the Services provided by Move Me (“Services”), you agree to be bound by these Terms and Conditions and Disclaimer. If you do not agree, you must not participate in the Services.
2. Description of Services
Move Me provides yoga, breathwork, and embodied movement sessions delivered in various formats, including but not limited to:
• in-person sessions at workplaces, aged care facilities, and private residences; and
• online classes and digital content (including any future subscription or membership platform).
3. Medical and Health Disclaimer
3.1 The Services are provided for general health, wellbeing, and personal development practices only and do not constitute medical advice, diagnosis, or treatment.
3.2 You acknowledge and agree that:
(a) You are responsible for your own physical and mental health;
(b) You will seek advice from a qualified healthcare professional prior to participation if you have any medical condition, injury, or concern; and
(c) You will inform Move Me of any relevant health conditions prior to participation where reasonably practicable.
3.3 Participation in the Services is undertaken at your own risk.
3.4 Pregnancy and Postnatal Participation
(a) Participants who are pregnant or postnatal must inform Move Me prior to attending any session.
(b) Participation during pregnancy or the postnatal period is undertaken at your own risk. Move Me recommends that you seek approval from a qualified healthcare provider (such as a GP, midwife, or obstetrician) before participating.
(c) You acknowledge that general yoga classes may not be specifically designed for pregnancy or postnatal bodies unless explicitly stated.
(d) You agree to modify your practice as needed, honour your body’s changing needs, avoid any movements that feel unsafe or uncomfortable, and rest when required.
(e) Move Me is not responsible for any injury, complication, or adverse outcome related to pregnancy or postnatal participation.
(f) Where appropriate, Move Me may decline or modify participation if it is considered necessary for the safety of the participant.
4. Assumption of Risk and Personal Responsibility
4.1 You acknowledge that participation in yoga, breathwork, and movement practices involves inherent risks, including the risk of physical injury.
4.2 You agree to participate within your own limits and to modify or cease participation as required.
4.3 Move Me is not responsible for any injury, loss, or damage arising from your failure to follow instructions or from overexertion.
5. In-Person Services
5.1 For Services delivered at third-party locations (including workplaces, aged care facilities, and private residences), you acknowledge that:
(a) The safety and suitability of the environment is the responsibility of the host and/or participant; and
(b) You are responsible for ensuring you have adequate space and conditions to participate safely.
5.2 Move Me accepts no liability for injuries or damage arising from unsafe or unsuitable environments not under its direct control.
6. Online Services and Digital Content
6.1 Where Services are delivered online or via digital platforms:
(a) You are responsible for ensuring a safe physical environment for participation.
(b) Move Me is not liable for injuries sustained during unsupervised or self-directed practice.
6.2 All online content is provided for personal, non-commercial use only and must not be shared, reproduced, or distributed without prior written consent.
7. Bookings, Payments and Cancellations
7.1 Payment terms will be agreed at the time of booking or engagement.
7.2 Cancellation terms (including notice periods and any applicable fees) will be communicated at the time of booking.
7.3 Move Me reserves the right to reschedule or cancel Services where reasonably necessary, including due to illness, safety concerns, or unforeseen circumstances.
8. Code of Conduct
8.1 All participants must engage respectfully and safely in all Move Me Services.
8.2 The following behaviours are not permitted:
(a) abusive, discriminatory, or harassing language or conduct;
(b) behaviour that disrupts the session or compromises the safety of others;
(c) participation while under the influence of drugs or alcohol in a way that impacts safety or the experience of others.
8.3 Move Me reserves the right to refuse participation, remove a participant from a session, or terminate services where behaviour is deemed unsafe, inappropriate, or in breach of these Terms.
9. Future Subscription Services
9.1 If Move Me introduces a subscription or membership platform:
(a) subscription fees, billing cycles, and cancellation terms will be clearly disclosed at the time of purchase; and
(b) continued use of the subscription service constitutes acceptance of those specific terms.
10. Limitation of Liability
10.1 To the maximum extent permitted by law, Move Me excludes all liability for any loss, damage, or injury arising from participation in the Services.
10.2 Where liability cannot be excluded under the Australian Consumer Law, Move Me’s liability is limited, at its option, to:
(a) the resupply of the Services; or
(b) The cost of resupplying the Services.
11. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law.

13. Intellectual Property and Copyright
13.1 All content provided by Move Me, including but not limited to class sequences, recordings, written materials, and branding, is the intellectual property of Move Me.
13.2 You are granted a limited, non-exclusive, non-transferable licence to access and use this content for personal, non-commercial purposes only.
13.3 You must not reproduce, distribute, modify, transmit, publish, or commercially exploit any content without prior written consent.
14. Indemnity
You agree to indemnify and hold harmless Move Me from and against any claims, liabilities, damages, or expenses arising from your participation in the Services or your breach of these Terms.
15. Governing Law
The laws of Victoria, Australia, govern these Terms and Conditions. Any disputes shall be subject to the exclusive jurisdiction of the courts of Victoria.
16. Amendments
Move Me reserves the right to amend these Terms and Conditions at any time. Updated terms will be published on the website and take effect upon publication.
17. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

By participating in Move Me Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and Disclaimer.
